Dhani mengaku ujaran 'idiot' yang dilontarkannya saat tertahan di dalam Hotel Majapahit tidak ditujukan kepada pendemo yang kontra deklarasi #2019GantiPresiden di luar hotel. Nah, salah satu elemen pendemo itulah yang merasa tersinggung lantas melaporkan pentolan grup band Dewa 19 tersebut ke Polda Jatim.
Karena ucapan 'idiot' tidak ditujukan ke pendemo, menurut Dhani, kasus itu tidak jelas siapa korbannya.
"Yang saya sebut idiot itu orang-orang di dalam (hotel), yang menghalang-halangi saya keluar, bukan orang-orang yang di luar," kata Dhani usai diperiksa sebagai tersangka kasus tersebut di Markas Polda Jatim, Kamis malam, 25 Oktober 2018.
Kuasa hukum Dhani, Aldwin Rahadian, menjelaskan bahwa subjek hukum dalam kasus kliennya tidak jelas. Karena itu, unsur pidana tidak terpenuhi.
Atas alasan itulah pihaknya melakukan upaya perlawanan, di antaranya dengan mengajukan tiga saksi ahli agar dimintai pendapat sebagai pembanding atas pendapat saksi ahli yang dipakai penyidik.
Tiga saksi ahli itu, lanjut Aldwin, adalah ahli informasi dan teknologi atau IT, ahli bahasa, dan ahli komunikasi. Dia memastikan tiga ahli yang diajukan benar-benar kompeten di bidangnya masing-masing.
Namun, dia tidak membeberkan rinci nama dan asal lembaga mereka. "Alhamdulillah, penyidik merespons baik saksi ahli yang kami ajukan," ucapnya.
Aldwin berharap pendapat saksi ahli yang diajukannya bisa mengubah sikap penyidik dalam kasus itu, yakni Surat Perintah Penghentian Penyidikan atau SP3 dikeluarkan, kasus disetop dan status tersangka Dhani tercabut. Karena itu, permohonan SP3 juga diberikan oleh pihak Dhani kepada Polda Jatim.
Kenapa tidak mengambil langkah praperadilan atas penyidikan dan penetapan tersangka Dhani? "Itu opsi dan hal yang berbeda. Tidak usah terburu-buru, dengan kepolisian merespons bahwa kita menyodorkan ahli dan diterima akan dimintai keterangan, itu satu hal yang baik," kata Aldwin.
Dhani menjalani pemeriksaan sebagai tersangka pencemaran nama baik dalam vlog berujar 'idiot' pada Kamis, 25 Oktober 2018, dari pukul 13.00 hingga 18.30 WIB. Vlog bermasalah itu diunggah Dhani di media sosial dan viral saat terjadi gesekan antara massa pro dan kontra kala deklarasi #2019GantiPresiden akan digelar di Tugu Pahlawan Surabaya, Minggu, 26 Agustus 2018.
